Tasman
prepared this report to assist the National Competition Council
to determine whether water facilities are likely to meet the
criteria for access declaration under Part IIIA of the Trade
Practices Act (TPA).
This study was
conducted due to the considerable interest in the industry in
the possibility of applying the declaration mechanism to the
water industry.
The report analysed whether:
·
access to services provided by water facilities would promote
competition in another market;
·
it is economically feasible to develop another facility to provide the
service;
·
water facilities are nationally significant;
·
access can be provided without undue risk to human health and safety;
and
·
access is likely to be in the public interest.
